INDIVIDUAL LIABILITY WAIVER
I understand that any activities I undertake with Lotus Revival Yoga in studio, in person at a location outside of the studio, and online, may require strenuous physical exertion that could cause injury, am fully aware of the risks involved and understand it is my responsibility to consult with a physician prior to participation. In consideration of Lotus Revival Yoga allowing and authorizing my participation in one or more of the following Activities: Yoga (inside, outside, live online, recorded, snowshoe), Mindfulness Coaching, Nutrition Consultations, Yoga Retreat (less than and more than 24 hours), Nature Walk, Guided Meditation, Workshop.
I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result and I, my heirs, executors, administrators or assigns expressly release and forever discharge Lotus Revival Yoga, its Employees and Contractors, and the Program Instructors, Jennifer Davey; and waive any claim against them, their shareholders, officers, directors, successors, heirs or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation.
In the event that any provision of this Agreement is deemed to be invalid or unenforceable, such provision shall, whenever possible, be interpreted, construed, limited, or severed to the extent necessary to eliminate such invalidity or unenforceability. All remaining provisions of this Agreement shall remain valid and continue to bind the parties. If required, the parties agree to negotiate in good faith a valid and enforceable substitute provision which most nearly reflects the parties’ original intent in entering into this Agreement or to provide an equitable adjustment in the event no such provision can be added.
Lotus Revival Yoga shall not be liable to me for consequential loss, loss of opportunities, or any special, exemplary, or punitive damages, suffered or incurred by me in connection with my participation in the Activities.
Lotus Revival Yoga's liability to me is limited to the sum paid by me in exchange for my participation in the Activities. I have read the above release and waiver of liability, fully understand its contents and voluntarily agree to the terms and conditions stated herein in consideration for those services offered by Lotus Revival Yoga.
